GENERAL TERMS AND CONDITIONS
Art. 1: General provisions
The e-commerce website of Ilyvero, a private limited company with registered office at Johan Daisnestraat 16, 9000 Ghent, VAT BE0874597728, hereinafter referred to as Ilyvero, offers its customers the opportunity to purchase products from its online shop.
The e-commerce website of Ilyvero, a private limited company with registered office at Johan Daisnestraat 1, applies these General Terms and Conditions to every order placed by a visitor to this e-commerce website (Customer). When placing an order via the Ilyvero webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance and in writing by Ilyvero. Art. 2: Price
All prices quoted are in EURO, including VAT and all other taxes or duties payable by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately. You can find the delivery costs on this page .
The price quoted refers exclusively to the items as described verbatim. The accompanying photographs are for decorative purposes only and may contain elements that are not included in the price.
Art. 3: Offer
Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer are not binding on Ilyvero. Ilyvero is only bound by a best efforts obligation with regard to the accuracy and completeness of the information provided. Ilyvero is in no way liable in the event of obvious material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, colour, availability, delivery time or delivery method, we request that the Customer contact our customer service department in advance.
The offer is valid while stocks last and may be amended or withdrawn by Ilyvero at any time. Ilyvero cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
Art. 4: Online purchases
The Customer selects their products from the range and fills their shopping basket. The shipping costs are added to the bill at the end of the order. When the Customer confirms their order, they must provide the correct shipping address. Payment can be made by bank transfer or via PayPal and the payment methods specified therein. The order is only valid and binding once Ilyvero has received payment.
Ilyvero is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders involving the Customer.
Art. 5: Delivery and performance of the agreement
When paying via PayPal, the order will be processed the next working day. Payments via bank transfer will be processed as soon as the payment appears in Ilyvero's bank account. During busy periods (November - December), the order may take up to two days longer to process.
Items ordered through this online shop are delivered in Belgium, the Netherlands, France, Austria, Germany, Italy, Spain, and Ireland. Other countries are available upon request.
Delivery is carried out by Fedex or B-post. Shipping costs are automatically calculated at the end of the ordering process and are borne by the Customer. Delivery times depend on the Customer's country.
Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.
Any visible damage and/or quality defect in an item or other defect in the delivery must be reported by the Customer to Ilyvero without delay.
The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier if the Customer's carrier has been instructed to transport the goods and this choice was not offered by Ilyvero.
Art. 6: Retention of title
The delivered items remain the exclusive property of Ilyvero until full payment has been made by the Customer.
The Customer undertakes to inform third parties of Ilyvero's retention of title if necessary, e.g. to anyone who might seize items that have not yet been paid for in full.
Art. 7: Right of withdrawal
The provisions of this article only apply to Customers who, in their capacity as consumers, purchase items online from Ilyvero.
The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the goods.
To exercise the right of withdrawal, the Customer must notify Ilyvero bv, Johan Daisnestraat 16, 9000 Ghent, +32 495 5211 88, light@ilyvero.com, by means of an unambiguous statement (in writing by post or by email) informing us of his decision to withdraw from the contract.
In order to comply with the withdrawal period, the Customer must send their notification regarding their exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Ilyvero, Johan Daisnestraat 16, 9000 Ghent, without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to Ilyvero.
The direct costs of returning the goods shall be borne by the Customer. The Customer is requested to return the items in their original condition and packaging, with all accessories and instructions supplied. If the returned product has diminished in value in any way, Ilyvero reserves the right to hold the Customer liable and claim compensation for any diminution in value of the goods resulting from the Customer's use of the goods beyond what is necessary to determine the nature, characteristics and functioning of the goods.
All returned items will be carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a shop. If an item has suffered a reduction in value due to use by the Customer, this will be charged to the Customer.
If the Customer cancels the agreement, Ilyvero will refund all payments received from the Customer up to that point, including the standard delivery costs, within a maximum of 14 calendar days after Ilyvero has been informed of the Customer's decision to cancel the agreement. In the case of sales agreements, Ilyvero may wait with the refund until it has received all goods back.
If the goods have been damaged during return shipment because the Customer has not packaged them carefully, Ilyvero reserves the right to deduct this reduction in value from the amount to be refunded.
Ilyvero shall reimburse the Customer using the same payment method that the Customer used for the original transaction, unless the Customer has expressly agreed otherwise: in any case, the Customer will not be charged any costs for such reimbursement.
The Customer may not exercise the right of withdrawal for:
- the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person
Art. 8: Guarantee
Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
To invoke the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact Ilyvero's customer service department and return the item to Ilyvero at their own expense.
Upon discovering a defect, the Customer must inform Ilyvero as soon as possible. In any case, any defect must be reported by the Customer within two months of its discovery. After this period, any right to repair or replacement expires.
The guarantee never applies to defects resulting from accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the item, rough handling, poor maintenance or any other abnormal or incorrect use.
Defects that become apparent after a period of 6 months following the date of purchase, or delivery where applicable, shall not be considered hidden defects, unless the Customer can prove otherwise.

Art. 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to Ilyvero, in the event of non-payment or late payment, the Customer shall owe interest of 10% per annum on the unpaid amount from the date of default, by operation of law and without notice. In addition, the Customer shall be liable, by operation of law and without notice, for fixed compensation of 10% on the amount in question, with a minimum of 50 euros per invoice.
Notwithstanding the foregoing, Ilyvero reserves the right to take back items that have not been paid for (in full).
Art. 11: Privacy
The data controller, Ilyvero bv, complies with the General Data Protection Regulation (GDPR) and the Belgian Privacy Act of 30 July 2018.
The personal data you provide will only be used for the following purposes:
- the performance of the agreement
- processing your order
- sending newsletters
The legal grounds are the performance of the agreement, consent, compliance with legal and regulatory obligations, and/or the legitimate interests of the company.
You have a legal right to access and, if necessary, correct, supplement or delete your personal data. In a number of cases listed in the GDPR, you may also request that the processing of your personal data be restricted. You may also object to the processing of your personal data if you have serious and legitimate reasons for doing so that outweigh our need to process your data. Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.
In the event of data being used for direct marketing: you may object, free of charge, to the use of your data for direct marketing purposes and are not required to provide a reason for doing so.
We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties.

Art. 13 Impairment of validity - non-waiver
If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall in no way affect the validity, legality and applicability of the other provisions.
Any failure by Ilyvero at any time to enforce any of the rights set out in these Terms and Conditions, or to exercise any of these rights, shall never be construed as a waiver of such provision and shall never affect the validity of these rights.
Art. 14: Changes to terms and conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to, and by Ilyvero's general terms and conditions of sale. In the event of any conflict, these Terms and Conditions shall prevail.
Art. 15: Evidence
The Customer accepts that electronic communications and backups may serve as evidence.
Art. 16: Applicable law - Disputes
Belgian law applies, with the exception of the provisions of private international law concerning applicable law.
The courts of the Consumer's place of residence shall have jurisdiction in the event of legal disputes. The Consumer may also refer to the ODR platform (http://ec.europa.eu/consumers/odr/).
